Key investment highlights

  • 0% capital gains tax and no income tax on rental earnings — the return you model is close to the return you keep.
  • 100% freehold ownership for foreign nationals in Dubai's designated freehold areas, with no residency requirement and no local sponsor needed to buy.
  • A property investment of AED 2 million or more qualifies for the 10-year UAE Golden Visa, including your spouse and children — with no minimum stay required to keep it.
  • Every off-plan payment is held in a project escrow account regulated by the Dubai Land Department and released against certified construction milestones.

Dubai is one of the very few markets where a foreign national can own freehold property outright, earn tax-free income from it, and use the same asset to secure long-term residency. This guide sets out the ownership rules, the tax position, the Golden Visa route and the purchase process, so you can decide with the whole picture in front of you.

Can a foreigner buy property in Dubai?

Yes — with one distinction that matters. Dubai has designated freehold areas where foreign nationals can buy and hold 100% ownership with a title deed registered in their own name. Outside those areas, ownership is restricted to UAE and GCC nationals. Almost every community an international investor would consider sits inside a freehold zone: Dubai Marina, Downtown Dubai, Business Bay, Palm Jumeirah, Dubai Hills Estate, JVC and Creek Harbour among them.

You do not need to be a UAE resident to buy, you do not need a local sponsor, and you can hold the property in your own name or through a company. Ownership is registered at the Dubai Land Department, which is what makes the title enforceable rather than contractual.

What ownership actually gives you

Freehold title in a designated area carries the same rights a domestic owner holds: the right to occupy, to let the property, to mortgage it, to sell it, and to pass it on. There is no distinction in the register between a foreign owner and a local one.

The tax position for overseas owners

Dubai levies no capital gains tax, no annual property tax, no wealth tax and no income tax on rental earnings. Rent paid to an overseas account is not subject to UAE withholding tax, and the proceeds of a resale are not taxed in the UAE.

The cost of holding property here is transactional rather than annual-tax: a 4% Dubai Land Department transfer fee on the property value — typically shared between buyer and seller on a secondary purchase, and payable by the buyer on off-plan — an agency commission of around 2% on secondary sales, and the annual service charge set by the building's owners' association.

One caveat stated plainly: the UAE position is not the same as your home country's. Depending on where you are tax resident, rental income or a future sale may be reportable there, and how you hold the asset can matter. We tell you what the UAE position is and recommend you confirm your own jurisdiction's treatment with your tax adviser.

The Golden Visa through property investment

The UAE Golden Visa is a 10-year renewable residency, and property investment is one of the routes to it. The threshold is an investment of AED 2 million or more in eligible Dubai property.

What the property route requires

  • A property investment at or above the AED 2 million threshold, held in a designated freehold area.
  • The investment is assessed against the property's value and the documentation you can evidence — valuation, title or off-plan registration, and proof of payment.
  • The visa itself is issued by the UAE's residency authorities. We confirm the current documentation requirements with them for your specific case before you commit to an asset, rather than after.

What the Golden Visa gives you

  • Ten years of renewable UAE residency, with no employer or sponsor required.
  • No minimum stay: you are not obliged to live in the UAE to hold it.
  • Your spouse and children can be included on the visa.
  • An Emirates ID and a UAE bank account — which is what unlocks local financing, utilities and banking as a non-resident.
  • A renewal path: the visa is renewable while the qualifying investment is maintained.

How to buy — locally or entirely from abroad

The process does not require you to be in Dubai at any point, although many investors choose to visit for the shortlisting stage. Every step below can be completed remotely.

  1. Define the mandate. Before looking at a single listing: budget, currency, holding period, target net yield and whether residency is part of the objective. This is what turns a property search into a decision.
  2. Shortlist and verify. Confirm the unit is inside a freehold area, check the developer's delivery record, the project's registration and — for off-plan — the escrow account, before any money moves.
  3. Reserve the unit. A reservation deposit, typically 5–10%, takes it off the market and fixes the price.
  4. Sign the Sales and Purchase Agreement. This is the contract that matters: handover date, delay remedies, specification, payment schedule, service charge estimate and resale rights. We review it independently of the developer's broker.
  5. Fund through escrow. Instalments are paid into the project's escrow account and released against certified construction milestones — not to the developer's general balance sheet.
  6. Register with the Dubai Land Department. Off-plan purchases are registered on the Oqood register; a ready purchase is registered and issued a title deed. Registration is what makes you the owner.
  7. Complete remotely if you cannot travel. Investors abroad typically appoint a notarised power of attorney so a representative can sign and register on their behalf, or use the developer's remote signing process where one is offered.
  8. Take handover. Snagging, final payment, the service charge handover and — for off-plan — the title deed on completion.
  9. Let, manage and hold. Rental placement, management and reporting, plus the Golden Visa application if residency is part of the plan.

The protections behind the transaction

RERA and the Dubai Land Department

Dubai's market is regulated by the Real Estate Regulatory Agency (RERA) under the Dubai Land Department. Developers must be registered, projects must be registered before they can be sold off-plan, and sales contracts follow a standard framework. Disputes are handled through RERA's resolution channels rather than a developer's internal complaints desk.

Escrow

Off-plan buyer payments are paid into a project-specific escrow account under the Dubai Land Department's oversight and released against certified construction milestones. If a project stalls, escrow is the mechanism through which buyers have recourse — which is exactly why we verify the account before the first instalment, not after.

Your title

Ownership in Dubai is proven by registration, not by a contract. A title deed, or an entry on the off-plan register, is your enforceable right to the asset — and it is what any future buyer, bank or authority will look at.

What we do for international investors

We act for the buyer. That means an independent mandate rather than a developer's inventory, due diligence on the asset and the counterparty, an independent review of the sales contract, verification of escrow and registration, the developer's incentives disclosed to you in writing, and transaction management through to title deed — and, where residency is the objective, the visa application alongside it.

You are not choosing a property. You are choosing which asset, on which terms, with which protections — and how it fits the rest of your capital.

This guide describes the general position for foreign buyers in Dubai and is not legal, tax or immigration advice. Freehold designations, Golden Visa criteria, fees and registration requirements are set by the UAE authorities and can change; confirm the current position for your specific case before you commit.
